Thomas High Court bid to be decided this week

Terror suspect Jack Thomas will learn on Friday whether he can continue his High Court bid to stop his retrial.

Lawyers for Thomas then sought to stop the retrial, but the appeal court last month rejected their challenge.

Their next step was to seek special leave to appeal to the High Court.

Nicholas Robinson, SC, for the Commonwealth director of public prosecutions, today told Justice Elizabeth Curtain in the Supreme Court that Thomas’s special leave application was to be heard on Friday.

Justice Curtain said arrangements for a trial could be made if the application was unsuccessful.

If Thomas was granted special leave, the High Court would hear his case at a later date.

Mr Robinson said he expected a trial to last about a week.

Michael Croucher, for Thomas, asked that no potential dates be fixed until after Friday’s hearing.
